I just the DV letters out to them 2 days ago and even sent the OC a settlement letter to offer a payment. Luckily my supervisor told them nothing. I'm scared.... What do I do? confused1 Posted December 2, 2004 Author Report Share Posted December 2, 2004 Not that I know of. They sent me my first contact letter on November 17. They called on Nov. 18, 19, 24 and my husband called them on the 29th to offer a settlement, which they refused. I sent them the DV letters on 11/30 and another one to same CA but different address 12/1. I also sent the OC a settlement offer on 12/1 per DocDon's advice. Then the call this morning. Methuss Posted December 2, 2004 Report Share Posted December 2, 2004 I would get hold of a consumer protection lawyer and sue those monkeys for violating the 3rd party disclosure rule. If you have not been served to appear in court, they probably just tried to do this as a scare-tactic.Dere be big piles o coin in this one since they are trying to harass you into paying and are tarnishing you reputation with your employer. It is IMPOSSIBLE for them to just 'get a garnishment' as if they were sending your employer a simple letter. This is a nasty scare tactic, don't let them rattle you. What state are you in ? Student loans can garnish wages under the Administrative Wage Garnishment program without a lawsuit or judgement. I used to verify information to prepare garnishments all the time. However we did not disclose why we were calling. We would ask to verify if employed more than 6 months and income of over a certain amount per month. We could not say the word garnishment.
