HelpFixMyCredit
Hello Team,Maybe some can help me here. I received a letter at my Grandmothers home today for cell/pager bill back in 1995. The account was paid up until 1997. Acceptance has now bought the old account and they are coming after me for the amount owed $416.41 according to them.I called the debt collector on the letter fearing something was opened recently in my name and thats when I discovered the account was open back in 1995 and paid up until 1997. What steps can I use to get this problem out of my hair? I'm about to write them a certified letter disputing the validity of this debt and demand a contract with my signature to prove the debt is indeed my own. Judging from past experiences with this company, I know they can be a real pain in the a$$!This debt is quite old though. If this debt was paid up until 1997.. what is the SOL on this account? Lets just say for example the debt was paid up until 12/97, this means the SOL is 12/97+ 7 years right which would be 12/2004 (this month). Am I missing anything here? wunderwoman
I guarantee you that if you do debt validation you will be cleared. Asset Acceptance buys junk debts (old debts) so don't even take to heart that it was paid until 1997. Basically, they WILL NOT be able to produce a single thing that proves you owe this debt, and you will be cleared.Send the DV, CMRRR, and be sure to use the one in the sample letters from this site that they are to only contact you via mail.I could almost bet $500 that they will not be able to validate this debt.If I were you I would just say "I have no recollection of this account".Be sure to include in your letter that they are not to report this to any Credit Bureaus without proper validation or that they will be in violation of FDCPA and FCRA. Also, I bet you that your original creditor doesn't even have you in their system anymore.By the way, how long have you been at your new address? edubb007
Hey... Garunteed they are sending it to you now because you are about to hit the SOL. That's what they do! They almost have a reminder set up to harrass you one last time before you can beat them. I would not even send a DV till after the SOL is past that way they can't even attempt to reage the DLA. Yo.. Wunderwoman... NIce! I love NY!
LadynRed
Hang on -- there is only ONE state with an SOL longer than 6 years and that is WY which is 8. Where'd you get the 7 years ?? The 7 years for REPORTING has NOTHING to do with the SOL for legal action. What state ARE you in ???
Recovering Attorney
right, don't be fooled. Depending on the situation, I might just send them a letter CMRRR saying this is not your account and if they try to collect it, including putting in on a CR, you will sue them under the FDCPA and FCRA. File a copy and the green card with your valuable papers.
