What is the relationship between providian and Unifund?? Back in the spring I had a levy placed on my checking account. The papers I received were from an attorney representing Providian in May. And yet my Equifax CR shows debt was with Unifund in April. So my question is, if Providian hired an attorney and then sold the debt, should the attorney been representing Unifund?? If Providian starts an action but then sells the debt...see my confusion??? I filed BK shortly thereafter(pro se), and after that Unifund no longer appears anywhere on my CB. I am still fighting to get my money back...the funds were exempt from garnishment but then the bank told me that the attorneys office filed an objection. However to this date I have not received a copy of the objection, so it has turned in one big circular dilema.

Providian is one of Unifund's best clients, and most valued.

Don't ever think that the information on your credit report is accurate. Sounds like it's all screwed up.

The two things I don't get is for anyone to put a levy on your checking account, they had to get a judgment. Did they get one?

Judgments are sometimes sold to CAs for collection. That may be what happened.

I also don't understand where you said that the bank said the attorney filed an objection. Aren't you getting notice of these court activities??

If you aren't, then there is legal reason for it to be set aside, overturned, or vacated-depending on the circumstances.

I went to court against Unifund and won. Also check your state laws, they were not licensed to collect in my state and I got a judgment against them. Unifund buys paper and paper only, trying to work on your ignorence.. fight the battle and you will win!

I was informed by the ATG that they are looking into charges against them, or they are already doing so. Judge took my letter, filed it with the courts. Infact they never appeared in court. Scared I imagine.

I have also learned watching cases in court. If you fight it,, they will not come!

I beat the scumbags in court also when they took me to court, even had a chance to question one of the VPs!!

As an authorized user, it's like co-signing for a loan. If the main account holder can't pay-they will come after you.

Wrong answer. AU has no responsibility for the debt. A joint user would.

Doc-

Technically you are correct, and I should not have made a blanket statement.

However, in several court cases, CC companies have gone to court with copies of purchase receipts and made the AU pay for their part of the total debt when the main cardholder had filed for BK.

I am trying to find the website that had the cases but don't think I bookmarked it as I didn't figure I'd ever go there again...I'll keep trying.

But thanks for correcting me!!

I can see your point but I have never heard of this.

Keep us posted!

I was an AU on DF's Discover when she filed BK7. They showed up and tried to make trouble but the Trustee showed them the door. They then tried to come after me. I forwarded a copy of the Dunning letter to the BK Judge and never heard from them again.
