cory301 Posted December 4, 2004 Report Share Posted December 4, 2004 I have a judgement placed on me from ford credit from a repo. It was filed in 1993 for about 6000. The yearly intrest rate is 12% making the total around 14000. I forgot all about this judgement because they have never contacted me. We are about to close on an owner financing house and I am worried they will put a lien on the property. Looking through public records it looks like they were trying to garnish my wages back in 93 to 94 but for some reason it was dissmissed in 98. I was never served papers or notified about the garnishment. Could that be the reason no garnishment was imposed? In 2000 they renewed the judgement but still no contact. I am worried that they are just sitting around waiting for me to purchase something. I do not want to wake the sleeping dogs by trying to settle if they are not acting on anything. My question is, how long can this be enforced in Florida? I know the SOL is 20 years but can this be renewed? Can I file bk 7 if they attempt to collect or will it be too late then? I am considering bk now, can I file on this judgement with it being 11 years old? Also, is the 20 years start after the original date of judg. or the renewal date? Sorry so many questions. I am new at this and very scared and confused. I just have no way of paying the 14000. I have quite of few medical bills that will go in the bk filing but my biggest fear is this judgement. I think I have already pulled most of it out! Do you happen to know how long they can keep renewing the judgement in FLorida?
