willingtocope
Its like $217 or so to file a BK 7...that's it, if you do the paperwork yourself. If you need help, plan on $800 - $1200 in attorney fees depending on where you live. Most BK lawyers will give you a free consultation to help you plan. Be sure and pick one that's more than a "fill in blanks" kind of person, and one you think you can work with.
LadynRed
The filing fee is $209 and you can apply to pay it in payments.
bluealex915
Hello,In my home state this is what I did to save some cash. The first thing you need to do is get a copy of all three of your most current credit files and review them. Take a look at who is reporting that you owe them some money. Next you have a few of options, you can either have an attorney do it for you or you can do it yourself. What I did was a third option that I think alot of folks forget about. In my state there are some legal services that will complete the paperwork for you and even file it. In my case thier fee was only 200.00 dollars on top of the filing fee for the BK court. From start to finish my BK only cost me just over 400.00 dollars. Now keep in mind if you have property or some other assets this is not the way to go. If your BK is strictly CC debt and similiar debt then this way might be a good option for you to consider. My brother filed a BK and hired an attorney who charged him 500.00 dollars for his services on top of the 209.00 dollar filing fee. That attorney just sat there in court and basically did nothing but say about one or two sentances, easy money for the attorney who really did nothing. Now I am sure they have some type of service like this in almost every part of the counrty so just check around if you want to try and save some cash. File on everything that you can include in your BK, you want to file on anyone who is listed on your credit reports as well, as long as they meet the criteria to file on them. Some things you can't file on like student loans or tax liens. Well I hope that some of this helps you out in making the best descision you can. willingtocope
If you buy a copy of NOLO Presses "How to file for Chapter 7 Bankruptcy" it will answer a lot of your concerns...plus give you instruction on how to file should you choose to do it yourself...As to selling stuff to pay credit cards, if you've got documentation showing where the money went, it might actually get interesting. It depends a lot on the zeal of the BK trustee, but she/he may view that a preferrential treatment...if so, she/he will go after the CC companies to recover the funds. It won't be a problem for you, but it might hassle the people that contributed to your misery.
NL
willingtocope or anyone else?Did you guys file on your own.I have a stricltly CC debt, no income, no assets.I saw attorney, they want $800 + $209 court fee.Is it worth letting the attorney do it? Other than filing paperwork and then submitting, is there anything that it's good to have them for? Will they deal with any issues after the fact? Or anything else?Just not sure whether to attempt it myself or pay the $800. Let us know.NL
willingtocope
IMHO its probably better to have an attorney. They'll know the way the local trustee's operate and will offer some opinions as to what to say on the forms and how to deal with any problems that come up.Important thing is to "interview" several until you find one you're comfortable with. Like I said before, some are just "fill in the forms and mail me the money" types, whereas others will actually care a bit. You might want to go sit in on some 341 meetings to see if the lawyer actually shows up (technically, the lawyer isn't supposed to speak, but you should get a good feel for how they deal with their clients.)You can do it yourself...but again, I'd suggest sitting in on some 341 meetings to see how the trustees work... Pelon
I also have a question on this chpt 7 bankruptcy. I am thinking on filling also since i have a $20k debt for a car loan that i co-signed for. I own a house which my parents put in my name last year. they live in it. I also have around $10k in the bank. If i take the $$$ out the bank & take my name off the house can i still file/qualify? Would they see that i did these changes recently? What can i do?Angel
willingtocope
Yeah, any transfer of title on the house, or withdrawal from the bank is going to be a problem. You might see if you can find a BK lawyer to talk with. If your total debt is just the $20k, you may have other options...like settling on the car for the $10k you have...
