mzjazzyazz Posted December 7, 2004 Report Share Posted December 7, 2004 I have 2 accounts in collections, but the OC and CA are both reporting. Both of the accounts are $1300. One from Aspire Visa and the other one from Dell. Should I attempt to settle with the OC? What would be my first step? Do you think I should ask them to make the changes to positive tradelines? If so, then how would the CA get off of my report? The last time I made a payment to both of them was 2 years ago, but my lender is requesting that all collection accounts be off or paid on my report. Does the OC entry say something like "sold or transferred" or not? How long ago was the account placed in collections? (BTW--who is the OC?)It is always better (just in my experience and opinion) to deal with the OC if you can. But--this can still be possible. if they have just placed the account with an agency that will try to collect, then you can usually still deal with the OC. I can't seem to locate who the CA is now. I remember receiving a letter from one, but I thought the CA was on my report too. I must have been mistaken. The account was charged off September of last year, and then it states it was charged off 9/04 as well. (whats up with that?) The other account states that the balanced was purchased by another lender and the OC for that account was Columbus Bank and Trust aka Aspire Visa. Recovering Attorney Posted December 7, 2004 Report Share Posted December 7, 2004 Sounds to me like you should deal with Dell directly, and with Jefferson for the other. You can call, but do all followup in writing. And if you make a deal, make sure you get that deal in a writing signed by Dell and Jefferson, in case someone decides to renege on it. Obviously, don't tell them you need to clean this up becasue you want to buy a new car or whatever. Give em a sad story. If you have a figure in mind, get a money order for that amount and send a copy to them, so they know you are for real. And try to go as far up the chain as you can. Start with writing Michael Dell and telling him how much you admire him. Find out who runs Jefferson and write that person, too. Link to comment Share on other sites More sharing options...

I didnt call them then, but I did call them to respond to a settlement letter they sent me like a week after I sent a settlement letter to Dell. However, once they got me on the phone, they said Dell denied the settlement offer. I hung up and sent a dv letter CMRRR. They havent responded and its been over 30 days. They are not reporting, but they continue to pull my reports. Where should I go from here. The devt is for $1300. I offered $650 which was denied. The OC is not bound by the FDCPA.In order to address a CA, you have to request DV with them, and the information is obtained from the OC, sent to the CA who forwards it to you.
