goodmank Posted December 8, 2004 Report Posted December 8, 2004 I posted this in the mortgage section but I wanted as much feed back as possible.I purchased a new construction home from company A. Company A immediately sales the loan to company B before my first mortgage payment is due. I have made all payments to company B and assume that my bussiness relationship with company A is over. Fast forward two years and Company A pulls me and my wife's credit report. I send them a written request asking them what their permissible purpose was. They respond by claiming that my mortgage was in default and that the pull was permissible as they are required to audit all FHA loans that default whithin three years of origination. The thing is my loan is not in default, my wife is not on the loan she is only on the deed of trust and I do not believe company A can pull my credit report as we no longer have a bussiness relationship. Any thoughts or suggestions?
luckyduck Posted December 11, 2004 Report Posted December 11, 2004 Send a letter to company a requesting the following:1. What is my business relationship with you?2. Why did you check my credit?3. Provide strict proof of your answers to the above 2 statements. If you do not provide me with this information as requested by xx/xx/20xx, I will have to assume that you fraudulently obtained a copy of my credit report, and will have no choice but to take legal action. To avoid this, you can simply contact the credit bureaus and request that all inquiries made by your company be removed. You may still have a relationship with them, and don't realize it. Mortgages are weird in that regard. But did they have a PP? It's a minimum $1000 for fraudulently obtaining a CR.
goodmank Posted December 11, 2004 Author Report Posted December 11, 2004 I have sent a second letter and am waiting for their response. I will keep all updated.
