Tdbearnut Posted December 8, 2004 Report Share Posted December 8, 2004 I have a collection company calling me that states that I made a settlement agreement. I never signed anything however I have been paying this company for over a year. I havent paid since August as I was hit hard by the Hurricanes in FL. I just got a call today from the agency (Assett Acceptence) asking that I pay $200.00 to bring the account current per our agreement and then I can continue to pay the balance out. I asked for a statement of my account from the settlement date until current showing what I have paid and what I owe. They told me they do not do that and I cannot have one. I told them I was not refusing to pay the $200.00 however I want something in writing that reflects our agreement and my current balance. They told me they do not have to do that and if I do not pay the settlement agreement is null and void. Is this legal? What should I do. I do have a name of someone in the coporate office who I have spoke to before should I call them or send a request in writing. willingtocope Posted December 8, 2004 Report Share Posted December 8, 2004 I'm not trying to be critical here (we've all had to start somewhere) but you've actually fullfilled a collections agency (CA) dream. You've agreed to hand them money without them proving they have the right to collect and without them proving what they're doing with the money.I'd suggest you send them a DV letter, CMRRR...do a search on the other posts here and you'll find lots of good examples. Remember, a CA on the telephone is no better than someone walking up to you on the street and saying "hey, you had a CC, now hand over the money you owe them".You ALWAYS need to deal with a CA in writing. Now is just as good a time as any to get it started. While it is possible that you have run up a debt somewhere in the past, at this point, you have nothing to prove that these guys have the right person or the right to collect it.
