agn140 Posted December 8, 2004 Report Posted December 8, 2004 After receiving back a signed green is every call a seperate violation of the C&D?On the couple of times that I actually answered the phone the NCO collector refused to give me anything other than a first name.Don't they have to give you a complete identification ofwho they are?
c m chase Posted December 8, 2004 Report Posted December 8, 2004 If you've sent a complete C&D, they can contact you ONE more time....and that's it. Log each call...write down when they called, who you talked to, what they said, etc. Keep track of everything in case you need it later.I wouldn't count on that a judge would give you $1000 PER phonecall that violated....but the more you have, the more in your favor it will be. I don't think it's in the law that they have to tell you everything about themselves. Otherwise, it'd be illegal for them to make up names (which a lot of companies do 'for protection').
Recovering Attorney Posted December 8, 2004 Report Posted December 8, 2004 the statutory violation is <$1,000 per case, not per violation. You can plead it that way, but don't expect to get it.
c m chase Posted December 8, 2004 Report Posted December 8, 2004 Yes. But DO plead it this way....and see what they say. It's happened before.
