No action in 90 days of correction letter...?? Need advice.

I have a CO from Capital One from 2002. They were reporting me 120 days late every month even after the account was settled. Obviously, it had a very negative affect on my score and report.

I sent Capital One a letter and on September 18 they replied and said they would report the new information to the CRA's. They also said it could take up to 90 days for the information to show. Well it's 10 days away from the 90 day mark and there is still no change.

My question is, is there a way by law that if the information is still not corrected after the promised 90 days I could have the information deleted for false reporting?

I did have a CO deleted because they didn't fix them problem in time, can I take some type of action to make sure if they don't fix it in the 90 days I get it deleted?

I appreciate any help guys...Thanks

I was just wondering if you dipsuted this with CRA's initially and then call and say you have information regarding last payment? They then will ask you to fax and send a copy (CRRR) in snail mail. That will be quicker than a OC. you can also sue since they haven't corrected the matter. It depends on what kiknd of a process you want to go through.

Initially I did dispute with the CRA's. They kept on coming back saying the information was verified. Then I called Cap 1 and talked to a manager who admitted something was not correct because the account was paid off in 2002. About 3 weeks later I got the letter saying that they confirm the payment and the account has been settled as of the date of payment. It said within 90 days they would advise the CRA's that the account has been settled from that date.

Even on my reports it shows that settlement date and a closed account, but they were still hitting me with 120 day lates till Sept. of this year.

Honestly, best scenario is just to have it deleted, if it's by means of a lawsuit then I am all for it. Guess I just need the best advice...What do ya think?
