"The Plaintiff has demanded payment of said sum and the Defendant has refused to pay the same and no part thereof has been paid."

I am preparing to sue in Illinois Small Claims Court and I'm having a problem with this part of the form. Do I need to demand payment BEFORE filing this lawsuit?

The lawsuit is to a utility company for failing to comply with the FCRA and FCBA.

They could have been totally wrong, but I asked my court clerk about this part and she looked utterly confused. She ended up saying that statutory damages alone couldn't be filed in Small Claims Court. :?

I'd go up to your clerk's desk, be super nice, and ask them about it.

Unless, there's an IL expert on board that wants to help out.
