kissinger99
As the title says I sent a DV letter to CA and got back a copy of a letter stating that my gym membership had been revoked due to the last two payments not clearing my closed bank account. This account is almost 7 years old and I seem to recall paying it off, but alas can't find the proof. So I called the gym and asked about it and they have no information on me at all.So my question is, should I be asking the CA for proof that they own the debt or should I just pay it. The copied letter they sent me did say that the account would be "referred" to the CA if not paid. Thanks for any help!
DocDon
That's not good enough. The CA has to send you more "proof" then that. Tell them if they can't provide proper validation, they are to immediately cease collection attempts and remove any negative information including any inquiries made to the CRA's.Add that the SOL has expired on this debt, which they are well aware of.Should they continue to collect, they will be immediately reported to the FTC and their state Attorney General. kissinger99
I was under the impression that the SOL was 7 years? If so it wouldn't be up for another couple of months.

kissinger99
Thanks for your help so far. It is very appreciated. One more question, do you have any tips on how to word my next letter?
DocDon
Check the "Sample Letters" link at the top of the page.Add to that the Wollman FTC opinion letter and the Spears v. Brennan case, both explain what proper validation is since they seem to think you have no clue.
