It has been a while since I've posted. I had great results DV and disputing earlier this year and got burned out and now I'm back at it again.

I have had it with NCO.

DH has NCO on all three CR for BoA $1635. Long story short. BoA paid an electronic check that I had put a stop on over the phone just the day before. I had accidentally paid my corporate card twice. Needless to say they paid it and hence several (I mean tons of small transactions) bounced they paid all the transactions for most were debit card transactions already approved, no bounced checks, this amount is entirely bank fees. they basically said I'm SOL they have no record of stop payment, etc. So I stopped my direct deposit and opened a new account at new bank.

So NCO has the debt. In early summer, I DV'd and disputed, came back verified but no validation.

I then sent folllow up letters CMRR to NCO saying they were in violation, if they do not delete I will sue, etc. NOTHING in response.

In addition I sent followup letters to all 3 CB telling them NCO had failed to respond to, how could they verify if I could not validate? TU sent back frivelous letter the other sent saying it's verified contact NCO.

So I got really burned out and just took a break. I'm still getting settlement offers and mail from NCO on this. Last one was in September.

Should I try another round of DV since it has been so long, or just file Suit? I'm not sue happy and this will be my first, I just want this damn thing deleted. We are trying to buy a new car.

You only have a year from the violation to sue. Personally, I'd just sue them. You've already been through the wringer. No sense in going through it again. Get a lawyer, and see if you can drag BoA in on it to, for unfair and deceptive trade practices. It may be too late for them, but you should at least find out. I know it's too late to change history, but you should have slammed BoA when they first did this to you. You should get proof of double payment to your other creditor to use as evidence supporting your claim that you had cancelled payment. That will certainly be more credible than the lack of evidence NCO has provided.

I see a lot about NCO. They are collecting an account on me, but I have not dealt with them yet. Just got my first collection letter within the last month (I think it was the first one). Once you send a C&D do they ignore it and continue calling, sending letters, etc. If so, I'd be interested in knowing.

Can I recomend (sp?) a good lawyer who specializes in FDCPA and FCRA? Jerry Jarzombec of Fort Worth. I used him and he is great! He has almost 100 lawsuits total against CA's and CRA's.
