The guy left his number 866-788-1188 and a message stating that he is "conducting an investigation involving your name and state id"; however he did not mention my name. I called the number back and the same guy answers the phone "investigations" and I ask him what company it is. He says NIC. When I wouldn't give him my name he said see you in court.I've been rattling a lot of cages disputing items lately and I did not want this one to go by without checking with anyone.Has anyone ever heard of NIC, this practice, or anything like it? False or misleading representations [15 USC 1962e]A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section: (1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof. (2) The false representation of --(A) the character, amount, or legal status of any debt; or NOT TO MENTION:(5) The threat to take any action that cannot legally be taken or that is not intended to be taken. I would IMMEDIATELY report them to any and all government agencies that I could. Not to mention calling my police department and filing a report-with a detective. Sounds to me like the CA buddy boy wants you to think he is a detective. Let him find out how it works-from a REAL one. Sounds silly now, but oh will it make them shudder in court. If it gets that far. Save the recording and if you get another call from them, make sure you don't talk with out it being on tape. Let the dude hang himself more. Also tell him that he is using misleading and false tactics to try to collect and that you are reporting him to the proper government agencies.And ask him if he has been getting any nasty calls. luckyduck Posted December 17, 2004 Report Share Posted December 17, 2004 Actually, I was thinking of mentioning on the same lines that you can file a police report, and ask the phone company to place a "phone trap" on your line. Then they can trace exactly where it is coming from. If someone is calling you without giving you reasonable information as to who they are, and are threatening to sue you, it IS harrassment, and you can easily get the police involved and make it a criminal case. I think you have to file a police report first, then take that to your phone company and ask them to place the trap in conjunction with the police. CA's should not be allowed to hide behind a non-published number, and fail to identify themselves when you contact that number. If they're complying with the FDCPA, there's no reason to be so secretive. The more complaints they receive like this, the more they may be apt to do something about it.
