I am also going to be filing here for bankruptcy soon(california).what will happen if I receive a settlement before I file... is it exempt? what about after I file? does the court look at bank records after the process is done?thanks for the help... willingtocope Posted December 14, 2004 Report Share Posted December 14, 2004 According to NOLO PRESS's "How to file for Chapter 7 Bankruptcy" ...."Personal injury recoveries to $17,425 (not to include pain & suffering, pecurniary loss)...is a valid BK exemption.Strange amount...and I'd suggest you ask a BK attorney what that really means in your case... My husband filed a lawsuit against a company for an injury he received while on the job...and during this time, I was going to file BK for some CC debt....all of which is mine. I too am wondering what would or could happen to a settlement we receive if I still file BK.
