momof5 Posted December 14, 2004 Report Share Posted December 14, 2004 We are all aware of the fact that if you live in a different state than the one where the debt was incurred, Fed Law allows the CA to use the state with the longest SOL. Not true in FL!!! To the CAs!I found this in the FL Statutes:95.10 Cause of action arising in another state.--When the cause of action arose in another state or territory of the United States, or in a foreign country, and its laws forbid the maintenance of the action because of lapse of time, no action shall be maintained in this state. I moved here from SC. The SOL there is 3 yrs. In FL it is either 4 or 5. Because of that statute, SC's SOL is the one that applies. Link to comment Share on other sites More sharing options...
