help with this cap 1 account

okay,

i did my dispute and one of the things was an old capital one card that was opened in 2000(?) and was charged off a couple of years later. well, i just got a privacy guard alert that capital added derogatory info. this is what it says:

Date opened Balance Date Amount Stautus Date

CAP 1 BANK 00/0000 09/2004 $1026 09/2004

Payment status

Bad debt; placed for COLL

if it is charged off, can they keep renewing this??? and i don't see a collection agency showing up on my report for this account.

What likely happened is that in verifying your dispute they received updated information. They may have sent it to a collection agency very recently, and the collection agency hasn't contacted you yet (I think that's a violation, I think they're supposed to contact you within 5 days of receiving the account).

If I were you I'd call Cap One and find out when it was placed for collection and to who.

My cap one account was placed for collection once because I was too months behind (yes, they really are CRAP) but I was able to get them to recall it and reinstate the card, they just lowered my limit a bit, but this occurred within days of them placing it in collection.

i just got my experian report from my chod result. i got one deletion on a charge off, one dulplication deleted and the other 2 stayed. one of those is capital one....big surprise!

well, i was studying the report and i think i see what they are doing. it looks like they charged off the account at 180 days. that was $580. the date of status is 12-2000 and last reported was this month. according to the use of credit section on the report, i keep accruing charges by capital one. how can i keep getting interest charged on an account that was charged off?

anyone else had this problem? what should i do next? should i do a dv with capital or try disputing again with the credit bureau?

oh, and i called them and i was automatically forwarded to their collection agency, the westmorland group. they are a subsidiary of capital one, and they don't show on my credit report.

help!!!!

From what little you've said, it sounds like it may be reporting correctly -- depending upon the cardholder agreement, the balance could have doubled, but you'd need the cardholder agreement to know if the fees added were permitted by the agreement.

Westmoreland is Cap1's internal collections group.

Have you sent them a DV letter?

the account is charged off and has been since 2000. can they continue to assess fees on an account that is already charged off? i thought that means that the account is closed? or can a charge off be an open account? they are reporting both at the same time.

i haven't sent a dv b/c i wasn't sure what to do. i just found out who the westmorland group is so i haven't sent them anything.

i want to make sure i understand my options before i go forward and try to handle this. i guess the main thing i need to know is if a charged off account is considered closed and can fees be added to it?

oh, and i don't have a cardholder agreement. i was a terrible organizer and i never kept things like that! i am finally learning that those things are important. but at the time, i didn't understand the ramifications of screwing up my credit so i didn't pay much attention.
