CA called about discharged Household Bank debt

Hey guys. I got a call today from a collections lady who said she wanted a payment on a household debt. I was shocked she said that becuse the account was discharged back in Jan. when we filed BK7.

I just rechecked my three reports and there is no open CA on there, and the debt she was talking about is listed correctly as "discharged through BK 7."

I got her name and gave er my lawyers info, BK # etc. I also asked her seriously to not call me again and she gave me zero hassle about that.

The reason I'm posting is because I am wondering if it is legal for Household to be farming out collection on debts they know are discharged.

Anywayz, I didn't take it as a big deal or threat, just curiousity mostly. I thought I might get some feedback from DA BOARDZ! Hope yer all enjoyin' the winter holidays. Our baby girl is due in two weeks.

congrats on a new baby girl! i had a little girl 8 weeks ago. that is why i am here, gotta get a house for all the kids.

when we went through bk, they would call, and once given the lawyer info, no more calls. now, i do have things listed as "charge off" on my cr that are really a bk, so maybe some internal errors caused the account to go to them even though they reported it correclty. they can't come after you, though, once it has been bk'ed.

Yeah, I figured as much. Thanks for the confirmation tho. Hey, congrats on your new family addition. We filed BK7 last year (1/04) dischgd 4/04. In my hunt for a house (we're renting a nice one now but want to buy as well) the FHA 2 years after a BK looks like the best bet for us. If you haven't checked into it, it doesn't depend on credit and it's a federally insured loan you can usually get in with a low down. The catch is, you have to be 2 years out of BK dschge.
