kjay
OK. Here's the deal. I am dealing with an obnoxious attorney's office! I had been sending them Registered and Certified letters trying to settle this debt that is, now, 6 years old. No response was given. The last letter I sent basically said .."if I don't hear from your office, I will send a check for X amt, and if you cash it, this debt will be considered PAID AS AGREED..." The money order was sent, but still hasn't been cashed. It is NOT at either Mail Recovery Center. I KNOW they have the money order! Now, they want me to send MORE money! I am VERY aware of my rights regarding the statute of limitations! This debt falls off June 2006! What can I do about the money I sent, if anything? miracle
Why did you send a check with out some validation for the CA? If they didn't respond, they are the ones in the wrong. Is there anyway you can put a stop pay on the check? If you could stop the money from going through, I would until it comes back validated. c m chase
Eeek. Miss Miracle is correct...why on earth did you pay someone who wouldn't even contact you? They won't mark anything "paid as agreed"...it's a collection agency...it's listed negatively no matter HOW you pay it. The most it'll get is "paid". They don't have the ability to change the listing of the original creditor. If you were aware of your SOL rights...again...you shouldn't have paid. Whatever it is, since it's 6 years old, it's most likely PAST the SOL and you wouldn't have to have paid anyway. Reporting SOL is different than collecting SOL. It sounds like you're kinda screwed on the $ now because you sent a money order. I don't think those can be retracted. Just don't send them ANY MORE money.Where are you? What kind of debt was this? Did you ask for validation or did you just ask for settlement?
LadynRed
I have to agree... if the debt is due to fall off your reports next year, you may already be beyond the SOL for legal action to collect on a debt. What state are you in ?? When did you last pay the ORIGINAL creditor ?
