playmaker Posted January 5, 2005 Author Report Share Posted January 5, 2005 I had a univeristy loan in 1989 it was deleted from the credit burreau because of the time . However, in 03 because of their "Reaging" the account popped up on my credit report. Esssentially, they changed the account number and made up a payment history. I had a credit bureau supvisor call and the University collection department lied and said it was a new loan. It took me several months to have that deleted from all three bureaus. I told the supervisor i would sue so they decided to get a judgement on me for 1700. I tried to argue the Sol but they had a waiver clause on the loan. I did apppeal that decision i'm still waiting to hear something. Now I have my suit against them for 5k coming up. I thought maybe i could have the univerity loan contract made null and void because of their repeated violation of the FCRA. Also just got a letter from a collection agency requesting 3500 . How can a judgement for 1700 get to 3500 in 6months? The 1700 judgement already included legal fees and interest Link to comment Share on other sites More sharing options...
Guest Posted January 5, 2005 Report Share Posted January 5, 2005 I thought that the whole no SOL on Student Loands began in the 90s but I could be wrong.I didnt think anything that made you give up your rights was binding? I could be wrong .. I know there was some kind of weird thing people argued on those kinds of things.Now as to them reporting a new TL.. you could get them there big time. I think you have a chance to nail them there.did they serve you for the suit? did you get a default judgment? Did you just lose the case?As to the 1700 now being 3500.. its because there is post judgement interest as well as the interest before.Hope that helps some. Its debateable as to whether a person can waive their rights. My loan was a personal school loan. The reason i never paid because 13yrs ago they just never accurately reported my info.
