send DV Letter? Portfolio recovery

I've dealt with them before. It was a long time ago and before I found this site....I had no problems with them. They didn't sue.

I paid them in full and then, upon finding this site, disputed with them via email saying I didn't think the accout was mine even though I paid. Said I didn't care about the money, but would like it removed or completely validated. They deleted very quickly and very kindly.

Well, just because they have the account number doesn't mean anything. You need to ask them to see an accounting history of the debt (how do you know the amount is right?), signed documents by you, a copy of the contract (how can they say you had breach of contract when they dont have a contract?), etc.

If SOL is 6 years, you have quite a wait...you said last activity was 2000 right? You still have 2 years that someone can come in and get the debt from Portfolio and sue you.

If you're just wanting to try and make a settlement on this (like you'd mentioned in another thread), you need to write them and ask them about it. State that you want validation or make a settlement right now. Viktor suggested you do this at the end of the month. If you have the money, start negotiations now so you can give them $ by the end of the month...note that in your letter (though don't say that's WHY you'll have it by the end of the month). Always negotiate for deletion.

With that said, I'd personally still ask for validation. :D

one more question...do I have to Dispute w CRAs also>>>?? I do not have recent CRAs so not sure what it is reporting now...but I did try this in 2003 and they verified..so prob a waste to try again???

Just send DV letter? I am so afraid a DV letter will bring a judgment...AHHH!!!!!

Well, think about it this way....if they're going to bring a judgment on you, they're going to no matter what you send them. (Unless you tell them to go to hell...that might prompt them a little quicker. LOL)

If you send a DV and ask that they show you you really owe this debt and then they sue you, you can show the judge you were just trying to get factual information before you paid them any money. He's going to want to see that information too. If they don't have it, they don't have it. If they do, they'll send it to you and you can go from there.

Once you send the DV and they receive it, go ahead and do another dispute with the CRAs....assuming they're still on your report. That way, they have to list your account in dispute on the CRAs.
