Capital Management/Sherman Acquistions?

Not to long ago I received a collection letter in the mail from this Capital Management, stating they were collecting for their client Sherman Acq. about a providian account. I have not ever received anything from Sherman regarding this. They (Cap Mngmt) started calling, I have yet to have spoken to them, they keep leaving messages. I am in the process of preparing a validation letter to send out to them. Has anyone had any experience dealing with them? Should I also send a letter out to Sherman even though I've never been contacted by them? Their last message left said something about a time sensitive issue that needed dealt with by me or my legal counsel. If they can provide me with the proof of the debt, I am prepared to settle with them but I don't want to risk being sued in the meantime while I wait for their response. Thanks in advance!

First off, "time sensitive matter" is just one of their scare tactics. Don't let it bother you.

Second, have you received anything in writing from either? Is so, that's the one to DV, CMRRR, and include "...all further contact must be in writing...". If you haven't anything in writing, then check your CR to see if someone's reporting....if they are, send them a "found you on my CR, what's this all about...validate...letter".

And...be very careful about "settling" with a CA. First, you need to know if they really have the right person. Just because you had a Providian account doesn't mean they've got it right. Make them prove its yours and they have the right to collect. It also makes a difference at to whether the account is still owned by Providian, or if Sherman bought it.

Thanks for the advice..yes, i've received from them a typical 'we've been assigned by our client Sherman Acq. to collect on this debt, etc' letter. But wasn't sherman supposed to have sent me something in the first place? I have never received anything from them at all on this. However Sherman is the one reporting on my CR.

I honestly don't know the correct answer to this, so you may want to search on Sherman to see if there are other posts....but...

I would guess that you should send a DV, CMRRR to both Sherman and the CA. The one to Sherman should include something like "...I just found you listed on my CR...to my knowledge, I have never had an account with you people...verify this, or remove it...".

Sherman is a junk debt BUYER. They buy the accounts, and then they farm them out to various collection agencies to try to collect. You may not ever get anything directly from Sherman - and they NEVER validate - instead they send out these bogus 'affidavits in debt' letters which you must also dispute if you ever get one.
