johnransom Posted January 6, 2005 Report Share Posted January 6, 2005 I haven't been served yet, but I got letters today from several attorneys offering to represent me against Citibank, which has apparently filed suit. The good news is that I don't need these ambulance chasers - I have legal insurance which I found out today covers me for debt collection defense and I won't have to pay a dime.However, I do have some questions:1. Will they actually serve me or not - that is, are they even required to do so (in Alabama) for this type of case?2. Typically how long does it take for this kind of case to come to court? Assuming I let it, that is.3. If so, how likely is a garnishment? I absolutely cannot afford this - I work for a financial service company myself and would be fired.4. I have a couple of Citi accounts, but I suspect that this suit was filed by a CA attorney here in town who has been representing them on one particular account. I DVed them, and they failed to validate. I sent them the C&D notice last week (and also terms of settlement, BTW), yet here comes the lawsuit. admin Posted January 6, 2005 Report Share Posted January 6, 2005 Ya know, the first thing off the top of my head is that if a lawyer calls YOU to represent you on a case, then you have an excellent case, and by all means, take advantage of them!! No doubt they are working on contingency (meaning you won't have to pay a dime up front). Legal insurance is really besides the issue. You could make a lot of money!! Work with them. AL has a short 3 year SOL .. if you're beyond that you're golden.By law, they MUST serve you with the Summons and Complaint. johnransom Posted January 8, 2005 Author Report Share Posted January 8, 2005 The point of having legal insurance is that I can get professional help at a very low cost ($18 a month), and therefore have little risk if I lose.My accounts are just coming up to a year past due, so SOL is still a long way off. I retained an attorney just today, and he was staggered that they yet to serve me, although he thought my C&D and settlement offer may have helped. He wants to see all the DVs etc I have sent out to figure out where I stand. Frankly, because of my situation, it's looking a lot like CH13 is my only option at this point.
