Removing Judgements Included in a BK

I filed chapter 7 BK in 2003. I had 2 judgements at that time which I included in the BK and one that had been satisfied in 2002. I recently received my TU report and all 3 judgements are on the report under "Public Records". How long are these judgements supposed to remain on your credit report? And how can I get them off?

What you must do FIRST is get those judgments vacated at the court where they were issued. This should have been done at the time of your bankruptcy, but you can do it now. File a Motion to Vacate and the reason you state is your bankruptcy - list case number, date filed, date discharged and you'll probably have to show your creditor matrix to prove the judgment creditor WAS included in the BK.

Once you get them vacated, wait 30-60 days and dispute the judgments with the credit bureaus and you will likely get rid of them.

The only exception is the one that you had already paid in 2002. Did you get a letter of satisfaction from the judgment creditor ?? If not, see if you can get one now, and have it filed with the court so that the record at least reads that it was satisfied. It will stay on your reports for the usual 7 years. You can always try to dispute it, you might get lucky and it'll be deleted.

****EDIT** I just noticed you're in NY. In NY, PAID judgments MUST be removed from your reports at 5 years - not 7.
