ADVICE FOR ALL MEMBERS!!!

If you are on this forum for any reason, whether a new member or old, please do yourself a favor and learn the CIVIL PRECODURES for your STATE (including small claims) and FEDERAL COURT. Everyday I see a post like this....."HELP... I DV'ed the OC and they served me a summons, what do I do ??"

Try to learn the rules before you play the game. Get a copy of "The Federal rules of Civil procedure" and the Civil procedure and rules for your state, along with a copy of blacks law dictionary. Then READ them. I got mine off of Amazon.com used and they were pretty reasonable. That way you will know what do do if sued, how to answer complaints, how to file for, and answer discovery etc. All the rules are there. There will be no reason to "guess" at what to do. It will also be specific to your venue and state. You really need a forms book. It will show you the format and wording of every legal motion, pleading and answer that you can make, AND what to do with them!! The price may seem steep, even for used books, but it is well worth it. All the statutes and case law on this site are great, but it seems like alot of people need to know what to do with them.

Most of that information is not only available on this site (in the "Is There a Lawyer in the House" forum), but available for free online as well.

And YES, learn the rules of the game before you play.

Not only will it help protect you, but judges like to see the rules being followed. Nothing will get a case thrown out faster than not following the rules.

Yes, alot of the info is on this site and free on the web. I have found the Federal procedures online for free, as well as the Texas procedures and Texas statutes. Texas has its own laws similar to the FDCPAand FCRA. They also have the "Texas Deceptive Trade Practice Act" which is very broad and will cover most deceitfulor shady business practices. I would not say that Texas is very pro se friendly, but the knowledge is out there.

I would also reccomend the following books...

Nolo press-- "Legal research made easy"

"Represent yourself in court"

"Criminal law"

" The deposition handbook"

They are very generic (i.e. each state maybe different) but are very detailed and written in plain english.
