Question about CA not listing....

accounts as "disputed" on credit reports while in valladation. Im wondering if you take them to court for that violation, what is needed in needed in court? I have privacy guard but I dont check it every day, I check like once a week maybe 2x a week. Do I need to take a copy of my credit report for every day since I first requested valladtion?And if so, can I go back somewhere and request that info, from CRA or privacy guard? I hope those questions makes sense.

I think you are asking about a debt collector marking an account "in dispute" after receipt of a notice of dispute or request for verification?

No matter when a consumer disputes an account, orally or in writing, a debt collector is required to mark the debt "in dispute."

These are historically weak cases because it is NOT the responsibility of the debt collector to assure that the consumer reporting agency is reporting what the debt collector provided. It is common that a debt collector sends a notice to the consumer reporting agency that an account is in dispute, and the consumer reporting agency fails to report this. The debt collector is not liable in this case.

And if you did go to court, it would fall on the "date reported" or "date updated" on the credit report.

I would like to know where YOU get your information from!

A CA electronically sends this data. The CRA picks up the data by field (data position + length of field) and this is a DIRECT update/insertion in a non-human intervention process.

If the CA DID report it, it would be on the CRA.

Let's see. I get my information from the National Consumer Law Center, from case law, from many hours at the law library, and from law school ;)

So if a consumer has copies of a Universal Data Form, or an E-oscar confirmation of transmission from the debt collector showing they sent a correction for example, to the consumer reporting agency, but the consume reporting agency DID NOT REPORT the correction, whose fault is it?

NOT ALL information is transmitted electronically. Some if faxed....and I would imagine mailed to the consumer reporting agency.

IF (big IF) the CRA failed to pick up the date from E-Oscar, then you'd be right, but furnishers ARE responsible for the data they provide and you can darn well bet that the CRA's are going to deny heavily that they failed to do something.

Oh .. and case law and a law library will never reflect everything that can and does happen.. you're only getting a relatively small sampling. Real-world experience comes from manny, many sources and that's were people get their information from.

For anyone not in the computer field, computer software engineers dont like to admit defeat. If they write a program which has "bugs" as anyone would call them, the computer people like to call them "features." Some are intented, some are not.

Kinda like the flight simulator or pinball game within MS Word. Although that was more out of boredom I think.

PS- Yes there is a pinball game and flight simulator in MS Word

I have only been programming since I fell in love with doing it - about 15 years now. I actually have a degree in EE with a minor in Physics and was a "rocket scientist" for both the USAF and NASA for 8 years.
