Dutchbabies
I actually got my summons in the mail from the owners of our old house (we moved just a few weeks ago). Is this legal? It is a copy of the summons (I don't know what one would look like). No court number and not sign by the clerk (would that happen the day of court?). I talked to the CA and it seems legit. What do I do about it being sent to me by an unknown party?I have so many more questions regarding one debt- but just this for now- thanks
DocDon
You can look up your state's Service of Process rules here:http://debt-consolidation-credit-repair-service.com/phpBB2/viewtopic.php?t=3959
c m chase
I personally don't see how it could be a summons with no case number. Might also do a quick check with the courthouse to see if it's legit - never trust what a CA says...call the source. If it's not, that CA has some major problems coming its way. What all does it say? Who's the CA?
Dutchbabies
I contacted several attorneys today. I was so frustrated. But the last guy (out of 6) I talked to walked me through it all and suggested a few things. He said the summons was legit, to send a replay/answer asap. Put in it all reasons I would not be responsible for the claim, SOL, mislead at the time of the signing of the contract . . .also there is a space to put all hte FDCPA laws we fill they have violated! Good place to start for now.
