Please dont post in all caps....

If they do have your account-then they can pull your report. As unfair as it may seem.

I'm not sure what you were trying to say when you typed CORT THAT HAPPEN MON 17,2005

Not dissing you on typing-just cant make it out... If you can post a little more details as to what is going on, perhaps there is some advice for you.

Sorry you got slammed...

First off, never ever ever speak to a CA on the phone, unless you have bood preasure to spare. It won't get you anything, and you don't have to. Simply send them the DV letter CMRR I'm sure there are a lot of DV letters out there. I used the one from this site as a guide and modified it to suit my demands and needs. It seems to have worked for me, never once a phone call.

If they do call or start harrassing you find out the taping laws in your state. Her in Oregon it is a single party state, meaning either one of us can provide the consent. Next in that letter address the limited C&D so they won't call you. I can post my version of the letter if you want, but it's not a lot different from the ones in the Sample letters section.

Any collection agent is trained to be rude that's why they intimidate you to pay. Again, never talk to them, you don't have to.

Sorry I typed in all caps:

Thanks for the advice: One question though if I DV them, I still in a way want to pay and get rid of this account. How should I go about it, and still try to get them to delete the tradline?

I'm not sure, just yet.... I'm stil there with a ouple of others on my CR files. I've DV'd, now it shows in dispute.... Calvary hasn't changed, yet, but then they just received the letter I sent.

Hey jojo, I wonder if they got my DV the same day as they got yours,

I'll bet they're very similar letters

I'm dealing with these guys, too and Cavalry has yet to make any change to their listing on my report, but they just got my letter as well.

Sprint PCS got my letter, too. I haven't got a green card back from them, but one of their two listings just disappeared. NOw just the 11 Sprint PCS and Cavalry is showing up (different names on EQ and TU)

I'm anxious to see how this one shakes out. Good luck to you too, srav.

Sounds about right, I have 11 SPrint pcs on TU and calvary on Equifax. Did you send to the NY office or the AZ office? I sent it to NY and I've seen no change, as of today's pull.

DOn't know anything else, just yet.... but going to wait and see what they do, I've also already disputed with EQ and TU as not mine.... we will see :)

There is no reason to pay a collection agency unless you get a statement from them in writing that they are going to remove the tradeline from your reports. Follow the DV path and see where it ends up before you attempt negotiation with them. They have to prove that they have a legal right to collect the debt. And they have to prove it to the letter of the law. Remember-paying a collection account doesnt mean it becomes a positive impact on your reports. In fact-a paid collection account is just as bad as an unpaid one.

UPDATE:

after filling BBB complaint with Sprint PCS, I had a phone call from Billy Young. Very pleasant gentleman, who could see I wasn't to be charged ETF on my account, and apparently account closure didn't occure properly so it went to "non - pay " status. He is researching it, pulling invoice, going to credit out the ETF, back close the account to December 02 per emails receive on the 14th of Dec. 02. He then stated he would contact Cavalary and pull the account, dlete any reference and tradelines, etc. Overall a positive experience, so far. He will be letting me know actual amount and final bill from Dec. 02, which I said I'd pay to Sprint, I won't pay any CA.

He really was very understanding and helpfull. I wish everyone else success with them... but it looks like I'll be able to get rid of them..

Oh, he told me he would send it all in writting too :)

Wow..Deja Vu, I have 11 Sprint PCS on TU and Calvary on Experian & Equifax. I

Calvary hasn't responded on my DV yet, nor have they listed my account in dispute.

My 30 days will be over in a few weeks and then i'm sending ANOTHER letter..geesh

Anyone had luck getting Calvary removed? The SOL on this account has expired already.

I sure did. I didit through Sprint PCS directly, via BBB complaint. Worked very well... but in my case there were errors in billing and processing of the account and had some decent notes on it about it. Sprint PCS took care of it, and Cavalry followed along with Sprint's information, closed the accont and went away completely. They never did validate the debt. It also took some working with the CRAs too. Get your papertrail together and file complaint with the BBB. That seems to have worked for me. Oh, I also filed complaint with the AG for AZ, NY, OR and FTC complaint against Cavalry... Hope that helps.

I just got my first letter today from Cavalry advising me that they purchased ATT wireless/Cingular and that I have a balance of 181.00 dollars.

I immediately did up my DV letter and will be sending it out ASAP. I did not pull any of my reports as of this date and was wondering would this account be listed on my credit report already?

Yes, most probabble. Cavalry listed it on my CRA files right of, before even contacting me.

It's interesting how they purchased ATT Wireles/Cingular ???? Hmmm, That's interesting indeed. Someone else chime in on this one, but I'm thinking Mis-representation ?! Cingular, owned by Bell South (BLS) and SBC Communications (SBC) jointly in a 60-40 split... bought ATT Wireless and completed that deal last October. SBC is in the process of buying all that remains of AT&T .... I don't think Cavalry is big enough to buy out either SBC or Bell South. LOL

jojo67...I was lol about cavalry buying ATT/Cingular. I did'nt want to write a long post so I should have said cavalry had purchased the account for collection from Att/Cingular.

Buy the way, which reports does cavalry report too? I just checked experian and it was not on my report as of this date.

Hey, got to find some humor on all this LOL... Calvary started with EQ, then TU, and finally EX in about 2 months after the first ones.

jojo67,

Unfortunately, I don't have the kind of luck that you had with your account. My Sprint PCS account was truly mine, i just never paid the debt cause I couldn't afford to at the time.

It's way beyond SOL, but Calvary has yet to prove this debt is mine and if possible, I would like it gone. Thanks to DVing, I was able to get NCO off my CR's cause they were reporting the same debt along with Calvary.

But now I have Calvary and 11 Sprint reporting the same debt. 11 Sprint is only reporting on my TU and Calvary is reporting on EX & EQ. I've DV'd Calvary, but they have yet to respond so I gotta wait a few more weeks before I DV again.

*sigh*

The best I can offer, try the BBB. Sprint's business offices are very pleasant to deal with. The Sprint was my account, but when I moved to Oregon I had nothing but trouble with their services. Fortuanly or me they had a record of my emails. Cavalry never did really respond to my DV to them.

I wish you the best of luck with them, they are rather nasty to deal with. Try the BBB though, perhaps if all else fails, try working out a setlement you can live with. I'm sure some other folks have more advice to offer, I just got lucky with them. It seems sometimes the entire system is designed to cause us to sink into major depression sometimes. It's frustrating to have worked as hard as I have and cleaned my credit up and still get denials, the most recent from MBNA :( and I now have 0 colections, 0 lates, everything is almost perfect, except high utilizations, because of medical bills last year.

I called Calvary today about my account and they told me it was from 2001. Calvary bought the past due accounts for ATT/Cingular in March of this year, and he said they are trying to collect.

The kicker is I never had an accoutt with ATT Wireless and I ask for the cell phone number of the account. The number given to me began with

Area Code:::::260

I live in Pennsylvania did a reverse look up for area code 260 and it came back to Indiana!!!

Now I need to call a second number they gave me in New York to try and settle this mess, but I did send out my DV letter just in case I can't settle this over the phone

Sounds like you have a case of ID theft, or Fraud.... contact AT&T wireless *(Cingular)* and inform them this isn't your account....... you may need to file a police report, not sure how Cingular will handle that one. They are usually pretty good about such things. ALso let Cavalry now it's not yours, again filling the necesary paperwork. SHould be fairly easy to get rid of them in this case.... but they might cause you some grief first.

Hi All,

Calvary deleted themselves from my reports last week. YAY! I DV'd them twice and they never responded so I sent them an ITS letter with "Notice of ITS" in BOLD RED and ALL CAPs in the center top (because I was not playing) along with copies of their sigs on the Fedex's and the previous letters. I also typed the current Fedex Ground tracking # upper right side of the ITS letter in blue, as I do with all the letters I send . I gave them approx. 45 days total. I had disputed with the CRA and they had verified.

Oh, and in the letter I gave them 5 business days upon receipt to delete or I'd sue and they deleted 1 day after they received my letter.

Hope this helps and Good Luck!
