would this be a violation?

I DV'd a collection agency - they signed the green card on 12/20/04. Once i got the green card back i sent in my disputes with the big 3. EQ signed their green card on 1/6/05. I have yet to get a response from teh collection agency, but EQ has already sent me results sying they verified the accounts. The results said updated 1/2005. How can the collection agency verify with them before they do with me?

I believe the CA has to respond within 30 days. I would wait out the 30 days with the CA and see if there is a resonse. If there is no response, then yes.. it is a violation. They can not verify with the CRA and not respond to your request. And.. if you your accounts aren't marked as disputed, it is another violation as well :)

miracle - from my understanding the 30 day rule does not apply to the CA. A CA has 5 days after initial communication with consumer to forward written notice of the debt to the consumer. http://www.creditinfocenter.com/legal/FDCPA.shtml#809

At that point the consumer has 30 days to respond to the CA. It's probably a good idea to wait a few weeks then DV the CA once again. If the CA still doesn't respond, then I would forward my green cards to the CRA asking how could they verify a debt that the CA couldn't. I would also ask the CRA for name and address of the verifying agency.

Just a suggestion based on my experience.

CLM- If the OP used the sample letter posted on CIC... the OP requests they respond within 30 days. I am not sure if I am making an incorrect assumption as to whether or not OP is using one of the sample letters that requests response within 30 days.

However, if they haven't responded and continue collections activity... they are with out a doubt in Violation. For them to verify with a CRA, they are in violation. The other reason I say wait 30 days is to see what the other CRAs respond with, if it comes back verified or not.
