I have been reading the Arbitration refusal streams, but it seems like they will get the award anyway. Also could use help with filing a small claims FDCPA violation suit in cook cnty.I'm hoping to avoid it, but I may need a BK attorney as well.Any help would be greatly appreciated. Here is the situation. An MBNA account was sent to a CA, Advanced Call Center tech. I sent a DV and never heard from them again. W&A began calling and sent a letter. I DV'd them and was sent a CPU generated page with an account number. I was going to send a second DV when on 01-05 I received a 77% offer from them. I was drafting a DV/counter offer when today I received an NAF claim with an account aggreement form without a signature, ( there is an arbitration clause as well as an assignment caluse). I have read about the refusal letters, but what do I do if they get the award anyway as it appears from others that they will. Also, how hard is it for them to get a judgment after getting an award? nowayout Posted January 21, 2005 Report Share Posted January 21, 2005 ponch,What they did to dh (W&A, also an MBNA account) is get the NAF award and then they sent it to a collection agency in IL (Blatt,Hasenmiller, et. al) who then pursued to confirm the award in court to get a judgment. It's a very long story, but dh had a default judgment vacated and it was going to another arbitration hearing in the next city. Blatt/Hasenmiller called the day before and offered a payment plan (he does owe the money), which he accepted. The lawyer didn't want to drive up because of the weather, he claims. @@IMO, (I'm the one who did all the legal work for dh) they didn't have the validation/proof of the debt they needed going into the arbitration hearing and looked for an out, which dh took. I had to file all kinds of papers before the arbitration hearing was to take place and one was a set of interrogatories that allowed dh to ask them to answer questions and product documentation. I am assuming it is the court where the arbitration was filed. Also, should I include a second Dv letter with a counter offer, or is this a good time to file a small claim FDCPA violation?
