question about sears they did something illegal

I have a sears account on my credit report well actually I have 2 reports from sears They sold my account to 2 different collection agencys Is this illegal? Can I get both removed from my credit because of it?

Here is what credit report says for the first account sears 12/01 date of last payment 10/98 charge off for $xxxx customer unable to locate consumer.

The second one says cbusasears 12/04 collection

charge off for $xxxxx

account transferred purchased by another lender. Date of last payment 9/04 Both of these accounts have different amounts owed and different highest credit of limit

Thanks to this site I found out what cbusa was it's citi bank. I looked everywhere trying to find out who that was and found a number on here for citi bank and decided to call them and they said they bought the account from sears.

Looks like they re-aged, it is a violation. I have the same thing. Look forward to probably seeing something from RMA who buys a lot of sears debt and also re-ages them. I am getting ready to write up my fed. suit against RMA, even though they are now off my credit reports. DV them and disput it with the CRA.

Sorry I am new at this what is DV and CRA and where and how do I do it? I have already recieved mail from RMA and I called them to ask about the cbusasears account and they knew nothing about it. It didn't even show up on their files. Will I be able to get both of them off my credit because of this or just one? Should I call them and see if I can't get them to take if off CR by threatening to take them to court?

First, I would suggest reading the site. On the home page, there is a link:

You should do this and make yourself a plan. I'm not sure if this is your only ugly thing on your reports. I would also suggest looking at the DV flow chart. It is here somewhere. If I can find it, I will post the link. Also, look up at the top of the page, do you see Debt Validation? Click on that link and read up on it. On the home page, there are sample ltrs, and you will find DV there. Also, if you have the extra money, I would suggest ordering the book to reinforce the website.

Yeah, they should come off real easy. If RMA didn't know anything about it they shouldn't verify the dispute with the credit bureau. A DV is a letter you send to request validation of a debt. There is one in the sample letters section on this site. (look at the top of this page!) weak it a little to give your own personal touch and send it certified and returm receipt (CMRR). If you have your credit report, you can use the file number to dispute the info on-line.

Do I dispute it with all 3 CRA? Thanks so much for the help. I already disputed it yesterday because of the date of last payment being 9/04 which isn't true so should I call CRA and explain what I found out? I only disputed the one account cbusa I didn't dispute the other one RSKMGT sears which is RMA should I go ahead and dispute both even though i disputed the one yesterday? The sears account that was sold to RSKMGT (RMA) is a legit account I do owe that one. What I want to know is since they did this do I have a legit reason to dispute both reports on my credit?

You might want to file a complaint with the BBB of chicago ILL. on behalf of the sears complaint, and explain the reaging of the acct, also a complaint against RMA to the Atlanta Ga. BBB regarding the false reporting , RMA does have a home site WWW. RMA.com just to check out.
