wolfpup
I am trying to help my sister with a continuing garnishment (CG). Lanier Collection agency has had a CG a couple of times, but they have expired without any payments. The most recent one is about to expire next month and she has been paying $216 a month on this. She is a single mom, full time nursing student and works in the ER. I want to DV Lanier, but how would that affect the CG and is it even worth it at this point? We live in Georgia.Any suggestions would be greatly appreciated!Thank you!Shannon
admin
Do they have a judgment against her? That's the only way to get a garnishment. Or is she just voluntarily paying?
wolfpup
they did get a default judgment on her.
admin
How much longer does she have to pay? Can you make a settlement? You can DV the collection agency collecting on this judgment, just to see if they have anything to back themselves up.... wolfpup
she actually doesnt even have a total amount on it. she didnt get any paperwork on it. the garnishment is set to expire in February so i;ll send a DV for her and see what happens.Do you know if they can file another garnishment if i DV? Or does a continuing garnishment automatically renew?

Could it be that that's when she's paid up?
wolfpup
in GA they state that a continuing garnishment is only good for 6 months. it looks like they will have to file again to 'reactivate' it. i could be wrong, but that is how i interpreted it.
