Tourniquet416
i wrote a check to a rental agency for $100, but i don't know exactly when. it was sent to a collection agency. TransUnion investigated it and didn't change anything. do i call my bank and get a copy of my statements for the past 3 years, and what do i send to the Credit Bureas? do i need a copy of the cancelled check? would the bank provide me with all of my cancelled checked if i asked? thanks.i do have the $10 check the rental agency sent me back, because i overpayed them in case there was any interest. would that help? thanks.the CA is Natationwide Credit Agency.UPDATE: i believe i've found my bank statement with the check number. so i guess i call the bank and get a copy of the check? DocDon
Did you DV the CA or just dispute the tradeline on TU?Without DV, this sounds more like a communication error between the rental company and Natationwide Credit Agency.I would write the rental company and state their CA is verifying false information in violation of the FCRA and FDCPA (misrepresenting the status of a debt), and that you demand the collection be immediately recalled and all negative information removed from your credit files.Check your statements at the bank to get the exact date and a copy of the cancelled check. Tourniquet416
i just disputed the error to the credit agencies. they verified it, and says there is no change. but now this means i can now demand them to remove it?there's a total of $171 to this National Credit Agency. the $100 is supposedly for the rent that i already paid. i have no clue what the $71 is for. the beginning of the $71 read ATT55644....i had an old phone pill, but that was for $300 and something, and the dates are all wrong for that.i already called my bank and am getting a copy of my cancelled check sent to me. DocDon
It's probably the interest the CA is charging. I wouldn't waste my time dealing with the CA - they'll only give you the run-around and end up listing this thing as a "paid collection".To add: We need to look at their responsibility to investigate the accuracy of the information they are reporting. Would disputing with the CRA's make them pursue the same level of authenticating the information, say as with a DV, where they MUST contact the OC? Would the dispute and subsequent verification of info (not validation, since there was no request for DV) be an FDCPA violation for misrepresenting the character / legal status of the debt? And would that lead to reporting incorrect information with regard to the FCRA?Opinions?
