Settlement.......what exactly should i ask for?

Sorry admin.......im a newbie and trying to sort through this all and a actually makign some headway thanks to this great site and the great people that have been helping me! The settlement im working on is on an account i have with Chase but im negotaiting with the CA, the have given me an offer of 2900 on a 9800 balance and are offering to reage my acct and will allow me to make 6 payments at which time they will report my acct anywhere form an r1 to an r4 (still to be finalized) Ive recently been told to check the SOL on the acct but have no clue how to find the info i need to get and actually how to see if it falls in my favor as far as the SOL goes. Is the offer they are giving me the same as a paid as agreed never late? sorry for the rambling but like i said im a newbie and want to make 100% sure i dont forget or let them get me into something that isnt in my favor! They are going to get back to me today with the decision as to the reporting of the r1 through the r4. Thanks in advance for any help you are able to give me.......this site and the people on it are life savers!!

admin i forgot to mention ive been sending in monthly payments to them which i just found out have done nothing for me as they are still being reported as late because they failed to tell me that they would agree to accept the payment amount im making but that they would still report late each month as it is not enough to cover there minimum.....makes me furious that ive been so nieve, trying to do the right thing and once again getting bent over :x

:shock: I didn't realize you were dealing with a CA. Who is it??

A CA's account isn't an "R" anything...it's a collection. They wont be able to change the OC's tradeline (the R1, R4, etc)...only the OC can do that. Sure, they might be able to talk to them about it, but really, I wouldn't count on much.

Have you spoken to them yet today? What did they say?

Furthermore, you don't want a CA to reage your account...that's only good for an OC. Are you sure you've been dealing with the CA? Is it in-house collections or is it another company, do we know?

The ballgame has changed, my friend. We definitely need to know more specifics.

As far as the SOL goes...depending on where you live, the payments may have tolled the SOL, as is the case with Oklahoma. In order to find out when the SOL originally was, check your credit reports.

If you have an Experian report, it should say something like "30 days as of 5-2001...60 days as of 6-2001....90 days as of 7-2001." Well...take that last "30 days" date, subtract a month, and that should be your DOLA, which would begin the SOL.

The OC im speaking of is Chase and the CA that is calling is Household services, i am almost positive its not in house. The SOL is out of the question, isnt a factor and no i havent spoke to them today, i was holding off until i got some input from everyone on the site. So now which way does a lost newbie turn and what do i ask for and from who etc???? Thanks so much for your reply, im looking forward to hearing your thoughts now.

The first thing you need to do is read this section on dealing with the CA:

Then you need to send a dispute/validation letter (DV) to the CA. Send one to the OC as well. Read this, maybe it will explain:
