There are a few collection accounts on my wife's credit report (Merchants & Medical is the CA). I sent a request for validation to the company (CMRRR of course) and I received the green cards back in the mail (Nov 2004). About a month latter, I disputed the account to the CRA's. The CA verified the debt but never sent me anything to validate the debt to me. Is this a violation? On her credit reports, the account is listed but read "no status" and "disputed". Isn't the CA required to remove the account from the CR until they validate? What is my next step? violation? Should I write the CA or the CR's?Thank you in advance for the help. No. They are not required to send verification simply due to them listing on a consumer report.On her credit reports, the account is listed but read "no status" and "disputed". Marking it "in dispute" is the only thing they are required to do at this point because the validation period has either expired, or has not begun yet.Isn't the CA required to remove the account from the CR until they validate?No. reporting and validation are not connected at all unless it is within th e30-day validation period.If you want your validation rights to start, CALL the collection agency. If they attempt to collect the debt, and this was the INITIAL communication with you during which they attempted to collect, they are required to send you the notice of validation rights within 5-days of the phone call if they did not provide them orally. If they do not, it can be a violation. Also, your 30-day validation rights period begins when they give you the notice of validation rights (or should have given them)If you send a request for verification then, they would have to cease collection attempts or send verification.
