ynkewmn
Does anyone know here if a process server has to DATE and SIGN a summon if they leave it with someone at your residence? I live in IL, and checked the rules for my state, but I'm just not understanding it.
c m chase
I would assume it has to be dated and signed...otherwise, how would anyone know when and by whom it was served? The summons I got was dated and signed as soon as I answered the door. ynkewmn
I have had four summons served, some left outside, some received by household members, but NONE dated and signed. Like you said, wouldn't that be part of the proof? Anyway, unfortunately we have filed BK now, tried all other avenues, and since I fractured my wrist with surgery in November, no other way out. I guess I will have to includes default judgements in the BK, but thought I could possibly have them removed because of improper service. That was the plan in the beginning anyway. If this process server is one in the same, he really doesn't know the laws.
