katy Posted February 1, 2005 Report Share Posted February 1, 2005 so i'm currently fighting with an attorney trying to collect(what has now become) $18,000 on an original 2,000$ balance after 5 years...went to court, got the default judgement removed - the lawyers (not licensed, nor bonded in the state of MA) have not shown up-twice.They have yet to reply to the d.v. letters, requests for information, proof - anything. Today I recieved a letter, "final request for answers to the interrogatories" which i assume relates to their request for info about the account they have no proof of.How do i answer their request - another d.v. letter - they have yet to furnish ANYTHING except for summons and letters.thanks! Guest Posted February 4, 2005 Report Share Posted February 4, 2005 Did you get interrogatores from them?This would have to do with your court date and you would need to answer them.You might want to look into filing counter claims and ask for your own set of interrogatories and ask them everything you have in the DV letters and even moreLook at CM Chase's posts on her lawsuit... she has done AMAZiNG work and it should help you out. I've taken most of my stuff off the net (in case of spies! hehe), but if you need an example of anything, let me know via PM....I probably have something you could use.Rule of thumb with interrogs is, as I understand it, object to just about anything you can. If there's one word in there that you don't "understand" you can object for it being too obscure. If the question could imply more than one thing, object on the grounds that you are unsure to the nature of the question. Things like that.You can also post the actual Interrogs if you want and people can help if they know how to answer them. There are also a TON of samples floating around if you want to send your own.What are the details of this case? When? Who (collector or original creditor?)? Is this a new, separate case?
