adent
I have my TU CR from 12/03 showing they DELETED a TL based on my dispute. Today it reapears. If they do not send me notice in 5 days can I sue and under what statute. Is there any statutory damages??? My FAKO tanked 21 points.
c m chase
You're going to need to take more steps than that.First of all, you need the notice from TU saying "We have deleted this account from your file" - or somehow stating they did it based on your dispute.Then...if you don't get the notification (which you won't), you need to send them a letter showing them the deletion, reminding them of the 5-day rule, and telling them to delete it again. If they don't, you might want to send them another letter stating the above and including your proof and past documents. Courts and judges like to see that you TRIED 'by all means necessary' to take care of the action prior to sending it to court.
adent
I do have the page that shows investigation results deleted. I will wait the 5 days and send the letter. Assuming I do all this, is there something I can sue for?
Guest
Yes.. if you make attempts with TU to coreect their mistake then yes you can sue them for 1000 and any damages you might have if you are denied credit based on that TL.Hope that helps
