Steel Cowboy
I found this last week on my Equifax Report...FIDELITY NATIONAL BANKPO Account Number: XXXXXXXXX Current Status: CHARGE-OFF Account Owner: Individual Account. High Credit: $0 Type of Account : Installment Credit Limit: $0 Term Duration: 60 Months Terms Frequency: Date Opened: 03/1994 Balance: $14,215 Date Reported: 12/2004 Amount Past Due: $0 Date of Last Payment: 11/1994 Actual Payment Amount: $0 Scheduled Payment Amount: $0 Date of Last Activity: n/a Date Major Delinquency First Reported: 12/2004 Months Reviewed: n/a Creditor Classification: Activity Description: n/a Charge Off Amount: $14,215 Deferred Payment Start Date: Balloon Payment Amount: $0 Balloon Payment Date: Date Closed: Type of Loan: AutoThis account was included in a BK on 1/95. (I am digging up my papers to be sure, but it was my 2nd highest debt so I don't think I would have for gotten it). This "mysteriously" surfaced on my EQ report the same month my BK fell off (12/04). This was the first time a major delinquency was reported (12/04). The last payment was made on 11/94.I sent a dispute certified mail last week to have this removed by EQ (for obsolete information) and have not gotten my green card back yet...however...After checking my EQ this morning, the status of this acct. has been changed to OPEN, PLACED FOR COLLECTION, SKIP.If this was included in my BK, can they come back to me after 10 yrs. for collection? If it was mistakenly left out of the BK, has the SOL expired for Georgia?I currently have ordered a copy of my BK papers. This is a great forum! I hope someone can advise me on how to proceed from here.

DocPC
It's past the SOL for reporting AND collections. Dispute it as obsolete.
Steel Cowboy
Does the fact that this occurred in Georgia, and I have lived in Ohio and now live in Oklahoma have anything to do with extending or "tolling" the SOL?
c m chase
*points and laughs* Another poor shmuck stuck in Oklahoma!!! I don't think moving tolls any SOL...unless they can show you were 'hiding' from the debt. I don't know what the time limit is, but I believe once you move, whatever state you live in is the state's rules you have to follow.

c m chase
Ooooooh, good job!!! GONE!! You can dispute inqs by calling them up. They mostly just give you a hard time about it though.
Steel Cowboy
do they take them off after giving you a hard time?
c m chase
Every once in awhile....but more so lately, they just tell you to bugger off, that inquiries are a 'statement of fact' because someone DID actually pull your credit. They say to go to the person who pulled. Keep after them though. Write if you feel more comfortable doing that.
