This account was included in a BK on 1/95. (I am digging up my papers to be sure, but it was my 2nd highest debt so I don't think I would have for gotten it). This "mysteriously" surfaced on my EQ report the same month my BK fell off (12/04). This was the first time a major delinquency was reported (12/04). The last payment was made on 11/94.

I sent a dispute certified mail last week to have this removed by EQ (for obsolete information) and have not gotten my green card back yet...however...

After checking my EQ this morning, the status of this acct. has been changed to OPEN, PLACED FOR COLLECTION, SKIP.

If this was included in my BK, can they come back to me after 10 yrs. for collection? If it was mistakenly left out of the BK, has the SOL expired for Georgia?

I currently have ordered a copy of my BK papers.

This is a great forum! I hope someone can advise me on how to proceed from here.

*points and laughs* Another poor shmuck stuck in Oklahoma!!!

I don't think moving tolls any SOL...unless they can show you were 'hiding' from the debt. I don't know what the time limit is, but I believe once you move, whatever state you live in is the state's rules you have to follow.
