Credit Union responded about repo balance......now what

I sent a dispute to the Credit Union regarding DH's repo. The documents returned were the "notice of intent to dispose of Motor Vehicle" and the "Notice of Defeciency Balance". Is that enough? It states where the vehicle was sold and how much it was sold for.

Also DH just told me that they never filed a judgement on him, but after they repo'd the car, they garnished his wages. Is that legal?

Where should I go with it from there? What other documentation should I request from them to make sure the repo was done correctly.

This repo happened in 12/99.

DH also told me that the letter of intent to sell was never sent to him, but he did receive a notice of defiency balance after the car was sold. He told me that when he came home, he thought the car was stolen, he called the police and it was them who told him that the car was repo'd. hmmmmmmm. thats interesting.

Ok, because it never said where the car was sold. It said he can pick it up at North Bay Auctions if heI wants to get the car back.

Where they supposed to mail these notices CMRRR?

The Notification of Deficiency Balance says

Unpaid Prinicipal Balance: $9,739.81

Accrued Interest and Late fees: $53.56

Repo and collection cost: $325.

Total amount due: $10,118

Gross Proceeds of Sale: $3520.

Deficiency Balance Due Now: 6598.37

Then they garnished his wages and he never received any notice of a judgement.

So in my next letter to them, what documents should I ask for?

Deficiency Balance Due Now: 6598.37

They indicate the "principle" balance, which would seem to exclude interest, but chances are it is the ENTIRE balance. You would have to do some work and find old statements to find out.

Was $3520 a reasonable price for the car at the time? You can check Kelley Blue Book FROM THE YEAR IT WAS SOLD to find out. Most libraries have them.
