SOL question and FCRA violations

Recommended Posts

I am currently disputing an account with America's recovery Network for an NSF check from the year 2000. I have since learned that the SOL on this is up I was wondering if that holds grounds for a lawsuit. I currently have them on several other violations of the FCRA and FDCPA. Also after my first request for validation ARN placed the same collection account on my credit again. Two reporting within 3 months to the same CRA Does that qualify for a violation in its self or would it fall under § 616. Civil liability for willful noncompliance [15 U.S.C. § 1681n]. Any information provided to me would be greatly appreciated.

Also I located and contacted the CEO Robert Green and made him aware of his wrong doing and he has failed to provide me any immediate resolution. I have filled complaint with the BBB and I am considering taking legal action.

If you've requested validation and they are still reporting it, that's one violation, continuance of collection activity. The other is trying to collect past the SOL. So I count 2.
