Paladin_Roden
I'm helping my sister fix some of her credit problems after I had found out I had problems myself without knowing.Anyway, my sister had a CITI bank card back in 07/1998, in 10/2000 she had to settle the account for less then the full amount, and paid that amount upon request making the account balance 0 at that time. Anyway, she disputed the account with Experian and Experian verified but they also "updated" it. They changed the charge off date from 10/2000 to 12/2004. What can she do about this? This of course made her scoure tank about 120 points because it makes this as if this account just got charged off and setttled. Whats the next step? Ngstone
I had a similar situation with Household- after I disputed it, it came back updated with a newer charge off date. What I did was this, sent a copy of my old report with a copy of the new report showing the change in charge off date, and disputed specifically the charge off date as incorrect. The outcome was great - Equifax came back again as "reported correctly as an individual account", which I was like WTF??? So I sent their corp office a letter threatning a lawsuit for not verifing the information I requested and got complete removal of the trade line . Experian fixed the charge off date back to its orginal date, so back to where I was there. Now Im going to keep validating different things on the account with experian until the screw up and I can nail them like equifax!
divemedic
See this:http://www.debt-consolidation-credit-repair-service.com/phpBB2/viewtopic.php?t=24361&highlight=Similar situation, everytime I tried to correct the incorrect information through letters (CMRRR, of course), they updated the TL to show it as a current charge off, even though the account has been closed since 4/2003. We go to court next Friday.
manucci
Hello:I had a similar situation; I disputed Amex charge off with EX, and the charge off date changed to current month; it is not the OC, but EX that does that. No matter what, you are lucky to come to this situation. Here is why.1. Copy the complete CITI's TL before and after change of Charge off date.2. Fill out a Small Claim court form, do not sign it.3. Send it, registered with proof of delivery, to CITI; 4. Demand they delete it, and pay you $1,000 for breaking the law.Don't bend over; don't negotiate; don't be nice to them. Let them know that you are serious, and you will bite them. They will try to explain that it was not their fault, and they will fix it.Your response, "Damage is done, and I seek justice"In my case, AMEX lawyer called me several time, and promised, AMEX will delete the whole thing shortly. Their TL was deleted the next day.The best defense is a strong offense.May the force be with you.Manucci
Paladin_Roden
Can you refer me to any law or regulation that is related to my situation. That way I have something they can refer to that what they did was wrong and I can get them to correct it or delete it. Thanks
Paladin_Roden
Ok I found the refereing law, FCRA Section 605© Running of the reporting periodThe next part is where I'm stumped. In order to fill out the small claims form I need the Registered agent information for CITI bank in Texas. I called the Secatary of State for Texas for that information, but they don't have it. Does CITI Bank have a registered agent for Texas? Because I can't sue without that information.
Paladin_Roden
Update::::I called the SOS office, no luck. I called the Texas Banking commision, no luck. I called the Office of Consumer Credit in Texas, no luck. I called the Comptroller of Currency in Texas, no luck but got some information. They told me that national banks do not have registered agents, I would need to find an excuetive officer or board member that lives in Texas and file suit against them. I not sure how this works, can someone help me out here. I don't want to screw this up.My situation is this.Citibank keeps updating a charge off as to the current month, even though the account was settled and paid back in 06/2001. How would I go about filing in small claims court against CITI bank. Anyone have any information they can help me out with so I know who to serve in my area on this matter. Citibank has a huge corprate officer building here in San Antonio Texas where I live, hell the street that the building is on is called Citibank Drive, I tried getting the information from Citibank themselves but they laughed in my face when they asked what the information was for and hung up on me.
