Anisah_H
If you go to small claims court to sue a ca or cra, will the court ask you if what you were disputting was yours? I would think that would be their defense. And if you reported it as not yours... Just wondering. I'm just starting my journey!Anisah in NJ
willingtocope
The good news about the FDCPA is that it has nothing to do with whether the debt is yours or not...its about making the CAs play by the rules. So, your basic answer should be "I don't know...they haven't provided me with the required validation"...
Recovering Attorney
the CA will try to make it about you. You have to firmy but politely remind the court that the FDCPA is a collector-focused law. Whether you owe the money or not has nothing to do with your claim and a question to that effect is objectionable as irrelevant. Of course, courts like to resolve differences, so if the debt is really yours and you know it, you should be prepared to talk turkey if it looks like your claimis not succeeding.
