Guest Posted February 12, 2005 Report Share Posted February 12, 2005 It was settlement.They claim they had rights to pull the Report but lawyer asked if they were willing to go to KY ((where Lawyer is)) to fight.The came back with that offer.I was happy with itI had not thought of liquidated damages but will mention it to my attorney.Thanks all!!! codename_fortyseven Posted April 19, 2005 Report Share Posted April 19, 2005 liquidated damages are a stipulation of an agreement where if a person violates, they instantly owe the other party X in relief. For example, if you sue a CA for violations, all parties agree to a settlement check of 1k plus a deletion of the TL, and you being the smart consumer add in a liquidated damages provision for 10k if the TL isn't deleted say in 45 days. 45 days comes and goes, and the TL is still on your credit report. You turn around, and demand 10k for violating the agreement set forth. They pretty much don't have a leg to stand on in court if they choose to go that route.
