Can Credit Card Company Contact Me On Sunday?

The OC can do pretty much as they please. The FDCPA doesn't apply to them. However, you might see if your phone company has a policy regarding "harassing" phone calls. Ten calls in a day is a bit much.

The other thing you might look at is a service from the phone company called "Privacy Manager". It works in conjunction with caller id...and it lets you decide if you're going to answer the phone or not. And, if the caller is using a caller id blocker, the call doesn't even get put through. Costs about $7-8 bucks a month, I think.

Thanks for the info. That is frustrating that the law only applies to CA's.

I will look to the phone company for help.

The really annoying thing is right now DH isn't even 30 days late. And we've already told them when he'll be able to pay...and it is before it's 30 days late.

We are behind on a credit card and they are calling us 10+ times a day...sometimes every 15 minutes. They are now calling on Sunday! Can they do that since they are the original creditor?

It's true that the FDCPA does not apply to Original Creditors BUT telephone harassment laws DO apply. MOST original creditors will stop calling if you send a limited cease and desist notice, limiting contact to writing only. Just mention in the letter that telephone harassment is against the law and you do not wish to receive any more collection calls from them. File complaints with your local phone company, the FTC and your state Attorney General and include copies of those complaints with your CD notice. (always send everything certified mail with return receipt.)

There is nothing simple about dealing with this crap. It takes a lot of time and energy to shut these jerks off, but it can be done. The other thing to keep in mind is that most collectors will not enter into realistic payment plans either verbally or in writing BUT especially not in writing. They are only interested in lump sum payments, over the phone.
