What can be on your report after a BK

What can be on your report after a BK? I am finding that the collection agencies are on there and the underlying account. They all have zero and include in bk in the notation.

Is there any way to remove these. Not only do I have the BK on reports but I have the negatives too. It is like I am being penalize twice.

Is this right?

Unfortunately, that is the way it works.

The CAs you can dispute to the CRAs and they will probably disappear. The CAs have no incentive to keep it there because they can't collect anyways. It's pretty likely they will simply not respond to the dispute.

The OC accounts will pretty much remain there, but they have little impact on your score after 2-3 years.

Been there - done that.

I can't speak to the CA accounts but (Included In Bankruptcy) IIB accounts from the Original Creditors can be removed.

I started with 10 negative IIB accounts on each report and I got Trans Union clear of all of them before the 7 year mark where they theoretically should have fallen off.

With some original creditors you can just state that they are reporting negative info. And ask them nicely to remove it.

With others if they are in violation of the FCRA complain and threaten to complain to, the (States Attorney Generals office) SAG, The Better Business Bureau (BBB), and whatever agency overseas the bank. For national (NA) banks that's the Office of the Comptroller of the Currency (OCC).

Even if the date of status or date of last activity, depending on which report you are looking at, is of by one month, then that's a violation. The date is supposed to be exactly the month you filed.

I can't say I agree with the 2-3 year thing.

When you get the last IIB account off and you are say 6.5 years out from the BK CH 7 your score should be 720 if you have opened new positive accounts and not made any more mistakes like late pay's or charge off's.

When I got all my IIB's and the BK CH 7 itself off of one of my reports my FICO score broke through the glass sealing from 718 and hit 782 At the 7.25 year mark!

I had a BK7 in 10/04. I have four OC IIBs, two CA IIBs, and the public record on there. I am trying very hard to get all of these removed asap.

I have disputed them all as "not mine". I am hoping to get them removed, but we will see. Also, there are some on this site who have had luck removing the public record altogether. This is my goal!!!! Nothing has been removed yet, but I am in the middle of debt verification and disputes right now. However, opening new trade lines and cleaning up inaccuracies on my CR has already brought my score up considerably.

10/04 FICO: 467/492/513

02/05 FAKO: 598/613/623

I'd be suprised if you get the public records removed this early after the BK. The docs are probably still at the courthouse and easily verified by the court-trolls (Lexis/Nexis and family). Once the docs get shipped off to the National Archives, it gets a lot harder for them to verify it. Once at the Archives, anyone wanting to verify will have to pay $35 to get a copy. This makes verifying a non-cost-effective option for the Specialty Reporting Agencies like Lexis.

How long the docs remain at the courthouse is going to depend upon how busy that court is. Big-city courthouses will clear out their records center of older material on about a 6 month cycle. Smaller courts that handle fewer cases can hang onto records for up to two years before sending them off to the Archives for permanent storage.

I spent 5 years as a legal records manager... In my BK it took 9 months for the court in Chicago to ship off my BK records...and they are a busy courthouse.

Thank you very much for that info. I know I'm tagging onto someone else's thread, but that info is very useful. My BK was in Philly, so I suspect the overloaded court ships them off-site frequently. I'm working on the IIBs first, then in two years or so, I wil work on the public record. I think that's a suitable plan.

I also wanted to thank those who post all this great info. And the moderators who keep the site up and running. This forum is invaluable!!!
