I am living in England at the moment where my credit is excellent, however I have a few small problems in the states. The worst one was Capital One, which I sent payment from here to pay off credit card. After a fews years I decided to check my credit report as we are moving back to the states in a few months. I found not only had Capital One not posted my payment but had me on there as charge off. I contacted them and they were charging me all this interest for late payments but also put me over my credit limit. I did not keep my receipt as I thought my account was closed. I however paid them almost $2000.00 which I did not owe. Now on my credit report there is an amount owed to Capital One $516.00 I have disputed this with experian and it keeps coming back verified. If I phone Capital One they say I have paid in full and do not owe them anything. Can someone help me I am frustrated and at the end of my rope lol which not very long to begin with, just long enough to hang myself. gprncss Posted February 16, 2005 Report Share Posted February 16, 2005 The CAs are bound by the laws of the FDCPA and the codes of the ACA (if they are a member).Unfortunately, they don't always adhere to it, because they take advantage of the fact that people don't know. That's why, it is strongly advised on this site to read it so you become well informed and let whatever CA you are dealing with KNOW that you know the law and if they don't comply, there are consequences.
