FCRA cover extortion?

Not sure how many of you know my situation, but for the last two months I been feuding with NCO Group. When I first looked at my credit report I found NCO had two collections that showed paid. I DV'd both of them and disputed it with CRA's. After two weeks I checked my credit again and they added six more collections and changed my orginal collection from "paid" to "unpaid". It was in retaliation to my DV letter. I was shocked they would do such a thing. I investigated everyone of those new collections and none of them are true, they are all made up with dates of service ranging from 2000-2002 for hospitals that I never even been to, plus I only seen the doctor twice in the last five years.

Anyway, I sent another DV letter and disputed again with CRA after they valadated it, so I can rack up the violations. I then proceeded to send a ITS letter in hopes they will correct the information, and stop there unbelievable behavior. Well after I sent the ITS letter CCRR, I get a phone call from NCO. They start trying to get me to settle, I was more then willing to listen. I informed them that the new collections they added are wrong, the other person on the phone didn't respond. NCO rep then tells me they will take off all the collections in exchange for $20 each collection they have listed, which is a total of 8 collections, six of which are bogus, and two have already been paid by my insurance company. I proceeded to tell them that I will not pay a dime for something that is not mine and that is more then likely made up. They then proceeded to tell me, it will be a cold day in hell when I see these collections off my report and then hung up on me.

Lucky I recorded the whole thing! WOOT for Texas phone recording laws.

okie dokey.. dont know on your FCRA question, but did you specifically state in your DV that disputed the accuracy of the debt?

Woohoo if you did, your in TX! What you can sue under is the TX deceptive trade practices act, as well as the TXFDCPA, you could make a lot of money off these idiots if you get your papertrail etc correct.

Also, demending settlement without validation is another. I love when a CA tells me that.

I had one that told me that he had a large team of lawyers and that I would "rue the day" that I messed with him. "Rue the day!" LOL. I think he watched too much TV.

@ days before trial, we settled. I rued my way to the bank with his money and a deletion letter in my pocket! Don't let them scare you.
