pursuit Posted February 18, 2005 Report Share Posted February 18, 2005 My brother worked for a startup restaurant that failed after a year and he is now owed approx $1400 in back wages. The owners - 2 sisters, tell him they don't have any money, even though their first restaurant is alive and well in the next town over. They tell him they are thinking about selling one of their homes to pay off their debts. I told my brother he better sue and get a lien placed on their house so that he's first in line to be paid. ladyblue65 Posted February 18, 2005 Report Share Posted February 18, 2005 Take them to small claims court win a jundgement and then get the fifa and place the lien on all their homes and businesses.Small claims is better cause you get your judgement within 3 days of the order.Look on all the county web sites around you get all their information. If they owe anything and still have a business open you just won.Just do you leg work at the court house get all the information on them that they have the means to pay. It cost me $58.50 to take my old landlord to court and now I have 2 liens on her homes looking to foreclose so I can collect my judgement. Georgia lets you foreclose in 60 days of default. Are they a corp or partnership, etc. The County clerk can give you the info from their business license.If there is not a seperate corp sheild there, in WA if you win a judgement in Small Claims you can do a Writ of Execution and have the sherrif meet you at the current place of business and start hauling out equipment, furnishings, etc. However usually if you get the writ filed an operating business will find the money to avoid having you take the stuff they use to make their money.
