My friend worked at a CRA and a question

Hi guys...

I had a friend who worked at a CRA. He told me that if they are trying to collect a debt that they had no SS# or no current address or a lack of certain iformation that they would search for all Joe bobs and mail out to all of them claiming that this was their debt and then allow them to call in and eliminate those who did not match.....

Now this has happened to me.. IN fact today. I contacted RMA today and they said that the information I had given them was not what was on the account and that they would not be sending any more mailings...

My question is what happens after they eliminate all that they can and end up with 40 people left? I think they place it on peoples CR and they end up weeding out more people that way until they are down to a few....

Anyway.... Does anybody know this??

Thats exactly how they do it. In fact, they relish the procedure because they can usually scare SEVERAL people into paying the same debt. The big JDBs arent raking in millions a year collecting one debt once. Im sure the FTC is already on the tail of next CAMCO as we speak.

Interresting....especially because it is a violation of the FDCPA.

It is illegal for a CA to communicate the details of the debt to anyone but the person who actually owes the debt. Flooding all names and addresses that are "close" would give rise to a cause of action for each person who receives a letter but doesn't owe the debt...since the letter would include names and amounts detailing the debt.

Since the FDCPA is a strict liability law that regulates the behavior of debt collectors and oweing the debt is totally irrelavent under the FDCPA, you do not have to be the one they are after to sue them for violations.

If a CA called you up and yelled at you to pay a debt and later it was determined that you were not the right person, you can still sue the collector. Dunning you with letters knowing that you may not be the right person is no different.

You think they care? Thats what this forum and others (AoC) are all about. Most people have NO clue about collection law. Violate all they want, they just have to pay a few people off. If EVERYONE hit them with suits, all of these companies would be out of business. FILE FTC AND STATE AG COMPLAINTS FOR EVERY SINGLE CA/JDB THAT VIOLATES IN ANY WAY!

I agree. The "battle lines" have been drawn - especially now that our elected officials have gotten into the habit of calling us "deadbeats", and are sleeping with so many businesses that they surely have an STD by now.

This makes it that much more important to fight back and welcome them back to reality.

I happen to have the same name as my father. I'm the III, he's the jr. We live in the same town though I have not spoken to him in 17 years. I do recall in I think '96, ford motor co. hounding me and threatening to repo my ford truck if I didn't pay up!!! They would not relent! I wish I knew then what I know now. I tryed to convince them I drove an eagle talon but they did not believe me! I also had a dentist office claim they had sent me numerous bills for 130.00 to my "new address". I had genuinely forgotten about that one! When I went in to pay the bill two years later the lady implied I was trying to stiff them. "Why didn't your father let you know about the bill??" She could not fathom the notion we could live in the same small town yet be estranged.

I know the when I worked collections, the computer system we used would not let us send out more than one letter at a time. We also had to have a reliable address change...post office, reference, family or friend...although enemies used to be a great source of new addresses. This held true on both our credit card and student loan divisions. I heard of multiple letters being sent from other agencies, but it was a strict no-no where I worked!

Certainly explains why I used to get so many phone calls CAs leaving messages for someone else whose last name was similar to mine. I had to call a number of them back and let them know they had the wrong number, they better stop calling!

Some years back I used to share a house with my brother and his wife, WE ALL have the same initials. CAs trying to be slick would call and say is ** avaliable, using first initial and last name only. Our answer each time was which one? Got them dumbfunded each and every time!! 8-)
